The High Court has declared the provision of separate pass in HSC illegal

edu-bdThe High Court has ruled that the provision of separate passes in the three subjects of the Higher Secondary / HSC examination of Bangladesh in the subjective, creative and practical sections has been declared invalid.

A full copy of the verdict, announced on January 29 this year, was released on Wednesday following a writ petition filed by a student named Tasneem Raisa last year. In the judgment, the provision of separate passage of HSC in Physics, Chemistry and Biology has been declared invalid.

Eight students from Dhaka City College who participated in the HSC examination of 2013 got A plus in Bengali, Biology, Mathematics and A grade in English and Physics and F grade in Chemistry. The results of his HSC examination were published on 3 August that year.

“In this (case) the applicant has got ‘A’ plus in SSC. Expected the same result in HSC. In this case, where there is nothing in the rules about re-examination, a decision may be made in its favor. The refusal to re-examine the answer sheet should be justified. ”

“As there is no provision for re-examination of the answer sheet, the decision has to be taken by the petitioner. The refusal to re-examine the answer sheet was done illegally, ”the court said.

The verdict said, “Since there is no provision for gazetting that it has to be passed separately and it is being called a failure only because it has failed in practice; That is why he (the petitioner) will be considered to have passed all the subjects. Now he can apply for re-examination if he wants. ”

Writer’s lawyer Shah Mohammad Ahsanur Rahman to the financier Said, Tasneem Raisa took the HSC exam from the science department in 2013- “That is why we have challenged the provision of passing those three subjects of science separately. The court granted our application and gave its verdict. ”

He further said that since the same rule has been introduced in other matters without any gazette publication, if anyone is in court on other issues, they will also get the benefit of this verdict.
